New Planning Rules Concerning Ground Source Heat Pumps.

The Town and country planning (general permitted development) (amendment) (England) 2008 was laid before parliament on the 13th of March and will come into force on the 6th of April 2008. The statutory instrument allows installation, in a domestic setting, of Solar PV, Solar thermal, Ground source heat pumps and flues for biomass/CHP systems subject to some conditions.

The key point with reference to ground source heat pumps is the following:-

The installation, alteration or replacement of a ground source heat pump within the curtilage of a dwelling house.

is now a Permitted Development Right. This means the installation no longer needs planning permission.

The Energy Saving Trust currently requires planning (or proof that planning is not required) for any Ground Source Heat Pump grant application under the Low Carbon Building Programme. This now does not apply.

However, if you put install a GSHP and a neighbour thinks that its noisy, and the EHO (Environmental Health Officer) rules that it is indeed a "statutory nuisance" then the noise will have to be reduced below whatever arbitrary level the EHO sets, and, if this is not achievable, then the device would have to be removed.
ASHP's have NOT yet achieved permitted development rights, which means that you MUST obtain planning permission BEFORE
fitting one.
